2. Description of Our Products
2.1. Essential Characteristics of the Products
These are used items with patina to a greater or lesser extent. It is not possible to describe every item down to the smallest detail, and we therefore use a set of standard descriptions, which should always be interpreted in relation to when the item was produced. For example, items from the 18th century will naturally show more wear than items from the 1950s. An item from the 18th century may therefore still be described as “Perfect condition” even though it shows more signs of wear/patina than an item from the 1950s.
|
Standard Description |
Meaning |
|
“Perfect condition” / “Perfect condition without flaws” |
The item has no damage caused by improper use, relative to the age of the item. There may be chips, cracks, discoloration, scratches, and glass sickness (not an exhaustive list). The item may still show minor signs of normal use. |
|
No specific description / “Expected signs of use” / “Natural signs of use” |
Items show signs of being used. This may include surface marks and scratches, scratches on the bottom of drinking glasses, marks in vases, and glaze marks on porcelain (not exhaustive). The item will not have chips or cracks caused by improper use. In addition, the item should be expected to have the features described under “Perfect condition.” |
|
Items described with flaws or defects in the text and/or shown in photos |
In addition to the described and/or visible defects, the item should be expected to have “expected signs of use.” |
2.2. Description of Jewelry
Our jewelry is characterized as vintage jewelry, where the content of harmful metals, including nickel, lead, cadmium, and mercury, is unknown and cannot be determined without unreasonable costs. Therefore, the jewelry should not be worn directly on the skin for extended periods, and individuals with allergies are advised not to wear our jewelry.
2.3. Sale on Behalf of a Third Party – Consignment Items
If we are selling on behalf of another person, it will be clearly stated in the description. If the seller is a business, their identity and address of establishment and place of business will also be disclosed.

Please be aware that additional costs may apply depending on the local import, customs, and VAT rules. We are not responsible for whether the local customs authority imposes this charge. In some cases, the charge is collected from the carrier, who in turn collects it from you as the recipient.
The full item value is declared on all relevant customs documents, and any attempt at manipulation will be rejected and may result in order cancellation without further notice. Any documented costs associated with such a cancellation will be charged to you.
3.4. Orders to countries outside the EU
Our products are sold under the special VAT rules for second-hand goods. Therefore, VAT cannot be deducted on export, as the VAT amount is embedded in the item's sale price and cannot be separated.

If an item is unexpectedly backordered, the entire order will generally be held and shipped only when all items are available. 6.2. Conditions for Exercising the Right of Withdrawal
The withdrawal period expires 14 days after the day on which:
a) you or a third party indicated by you (other than the carrier) takes physical possession of the goods,
b) you or a third party indicated by you (other than the carrier) takes physical possession of the last item in the case of an agreement involving multiple items delivered separately,
c) you or a third party indicated by you (other than the carrier) takes physical possession of the last lot or piece in the case of an agreement concerning delivery of goods in multiple lots or pieces,
d) you or a third party indicated by you (other than the carrier) takes physical possession of the first item in the case of an agreement for regular delivery of goods over a set period.
6.3. Procedure for Exercising the Right of Withdrawal
To exercise your right of withdrawal, you must inform us—Harsted Antik, Store Kongensgade 94, ground floor, 1264 Copenhagen K, email: info@harstedantik.dk, phone (+45) 4035 5485—of your decision to withdraw from this agreement by means of an unambiguous statement (e.g., a letter sent by post or email). You may use the withdrawal form in section 6.5, but it is not mandatory.
You must return or hand over the goods to us without undue delay and no later than 14 days from the date on which you informed us of your decision to withdraw. The deadline is met if you return the goods before the 14 days have expired. We recommend insuring the item when returning it, as you are liable for damage or loss during return shipping.

7. Buyer's Default – Failure to Receive or Collect Goods
7.1. Description of Buyer's Default
If you or a third party designated by you (but not the carrier in consumer purchases) (hereinafter collectively referred to in this section as “You”) fail to receive or collect the product on time, or your actions otherwise prevent timely delivery, you are considered to be in default (creditor's delay).
7.2. Consequences of Buyer's Default
Due to your default, we may choose to uphold or cancel the purchase under the Danish Sale of Goods Act. We may also sell the product at your expense or dispose of it if a sale is not possible or it is obvious that the sale proceeds will not cover the associated costs.
We may choose to sell the product at your expense in the following cases:
-
Storing the product would incur significant cost or inconvenience to us.
-
We agreed to re-ship the item, and you have not paid the additional shipping cost within 14 calendar days of that agreement.
-
You have not picked up the item in our store within 14 calendar days of our agreement or after being prompted to do so.
-
We are unable to contact you, or you do not respond within 7 business days.
-
If the 14-day deadline was missed due to our circumstances, the deadline will be extended by the corresponding number of days attributable to us.
-
Before we list the product for sale, we will, to the extent possible, give you at least 7 calendar days’ notice to collect the item from our store. The notice will be sent to the email you provided at checkout. Alternatively, it will be sent by post to the billing address you provided. If neither address is available and no other method of contact exists, or if there has been repeated default concerning the same purchase, we will not send a notice before listing the product for sale.
Our costs for resale or disposal will be offset against any amount owed to you, and any remaining expenses will be invoiced separately. Please note that we cannot automatically return funds to the account you initially used for payment. Therefore, you must provide your account and registration number so that we can refund any balance in your favor. If you do not provide the necessary bank details at the time of refund, we will charge an administration fee of 400 DKK + VAT, totaling 500 DKK, per calendar year started, until the full amount can be refunded.
8. Limitation of Liability and Damages
8.1. General
You acknowledge that it is not possible to develop an online software product that is completely error-free. Should errors occur on the website, we are responsible for attempting to correct them.
The applicable rules on compensation and proportional price reductions for defects or delays cannot be invoked against us, cf. however the Danish Sale of Goods Act, § 80, subsection 1, or unless the delay or defect is due to gross negligence on our part.
8.2. Product Liability
We are liable for product damage in accordance with the provisions of the Danish Product Liability Act that cannot be waived by agreement, but we disclaim product liability on all other grounds.
8.3. Technical Measures / Software
We disclaim all liability for loss or damage resulting from your own download of our products, including connection failures, system crashes, etc. The same applies to your other IT equipment, browser, software, etc.
8.4. Indirect and Consequential Loss
Under no circumstances shall we be liable for indirect losses or consequential damages arising in connection with the use of our services or products, including loss of business, loss of expected profit, loss and/or restoration of data, loss of goodwill, or any other consequential loss. This also includes no liability for advisory errors resulting from flaws or defects.
8.5. Force Majeure, Extraordinary and More Burdensome Conditions
In the event of extraordinary natural events, war, strikes and lockouts, import bans and blockades, epidemics and/or pandemics, or orders and recommendations from public authorities, system failures, cybercrime, IT security breaches, hacker attacks, cyberterrorism, ransomware, or other IT security breaches that significantly hinder or burden the fulfillment of the agreement, we reserve the right to cancel the arrangement without liability for damages.
9. Right of Complaint, Dispute Resolution, Governing Law, and Jurisdiction
9.1. Right of Complaint
When you shop with us, the rules of the Danish Sale of Goods Act regarding defects apply. This means that as a consumer, you have a 24-month right of complaint. If it is not a consumer purchase, the right of complaint is limited to 1 month. The right of complaint for non-consumer purchases ends the moment you attempt to resell the product.
Defects are assessed based on the item's condition at the time of purchase and how the item was described.
You must notify us of any defect within a “reasonable time” after discovering it or when you should have discovered it. If you notify us within two months of discovery, the complaint will be considered timely. If you are not a consumer, you must notify us immediately after discovering the defect.
9.2. Our Complaint Handling Policy
If you wish to file a complaint about your purchase, please contact us using the contact details listed in section 1.2.
If you return an item for complaint assessment and the complaint is deemed unfounded, you must pay an inspection fee of 750 DKK including VAT. Shipping costs are your responsibility and at your own risk.
9.3. Complaint Access for Consumers
If we are unable to resolve the issue together, you, as a consumer, may file a complaint with:
Center for Complaint Resolution

If you live in another EU country, you can also use the EU Commission’s Online Dispute Resolution platform.
When submitting a complaint, please provide our email address listed in section 1.2.
